1. Who we are

This website is operated by Cowichan Small Engines, company number FM0135282, of 7188 Progress Way, Delta, BC V4G 1C5, Canada. In these terms “we”, “us” and “our” mean Cowichan Small Engines, and “you” means the person or business placing an order. Contact us at info@cowichansmallengines.ca or 672 763 0632.

By placing an order you accept these terms together with our Shipping & Delivery, Returns & Refunds, Warranty and Privacy policies, which form part of the contract between us.

2. What we sell

We sell used engines, transmissions, drivetrain assemblies and parts imported from Japan. Every item is second-hand. Used imported goods carry cosmetic wear, surface corrosion, faded paint and Japanese-market fittings, and this is normal and not a defect. Photographs on a listing show the general type of unit unless the listing states that the images are of the actual item.

Engine and part numbers, displacement figures and vehicle compatibility notes are provided in good faith to help you identify a unit. Confirming that a part fits your vehicle is your responsibility. We will check fitment for you free of charge before you order if you send us the year, make, model and trim – we strongly recommend you do.

3. Orders and acceptance

An order placed through this website is an offer to buy, not a concluded contract. A contract forms only when we confirm the order in writing and accept payment. We may decline or cancel an order at any time before dispatch, including where the item has sold, where a price or description was published in error, where payment cannot be verified, or where we believe the order is fraudulent. If we cancel, we refund you in full.

Stock levels shown on the site are indicative. Where an item is inbound on a container rather than on the shelf, we tell you before you buy and give the expected landing date.

4. Prices, taxes and payment

  • All prices are in Canadian dollars and exclude freight and applicable taxes.
  • GST and, where applicable, PST are applied at checkout according to the destination province.
  • Freight is a flat $299 to any address in Canada, free on orders over $5,000, and is added at checkout before you pay. Local pickup at our Delta warehouse is free of charge.
  • Title to goods passes to you on receipt of payment in full. Risk passes on delivery to the carrier.
  • Accepted payment methods and when you are charged are set out on the Payment Options page.
  • We may correct an obvious pricing error at any time before dispatch. Where a price was clearly wrong we will contact you with the correct figure and you may cancel for a full refund.

5. Delivery

Total delivery time is normally 2 to 7 business days within Canada, Monday to Friday, counted from when your payment clears. These are estimates and not guaranteed dates – carrier delays, weather, ferry sailings and terminal congestion are outside our control and are not grounds for cancellation or compensation. Full terms, including freight options, liftgate service and the inspection procedure on delivery, are on the Shipping & Delivery page and form part of these terms.

You must inspect the shipment on arrival and record any damage on the delivery receipt before signing. Failure to do so limits what can be recovered from the carrier and may prevent a claim entirely.

6. Returns, cancellations and warranty

Your rights to return an item, the 30-day window, the 15% restocking fee on change-of-mind returns, who pays return freight, and refund timing are set out in the Returns & Refunds policy. Warranty coverage, its exclusions, the conditions you must meet at installation, and the claim process are set out in the Warranty policy. Both form part of these terms.

Items sold as-is or for parts, special orders sourced to your specification, and opened electrical components are not returnable.

7. Limitation of liability

Our liability is limited to the unit

To the maximum extent permitted by law, our total liability in connection with any order is limited to the price you paid for the goods. We are not liable for installation or removal labour, diagnostic time, towing, storage, rental vehicles, loss of use, loss of profit, loss of contracts, or any other indirect or consequential loss, however caused. Nothing in these terms excludes liability that cannot lawfully be excluded, including under the Business Practices and Consumer Protection Act (BC) or the Sale of Goods Act (BC).

8. Installation and fitness for purpose

Used engines and transmissions must be installed by a competent, licensed technician, and the service items listed in our Warranty policy must be renewed at installation. We are not responsible for damage arising from incorrect installation, from a pre-existing fault elsewhere in your vehicle, or from failing to correct the condition that destroyed the original unit. We give no assurance that a unit is suitable for competition, motorsport, forced induction beyond its original specification, or any modified application.

9. Compliance, emissions and registration

It is your responsibility to ensure that the unit you buy, and its installation in your vehicle, complies with the emissions, safety, inspection and registration requirements of your province or territory. Requirements vary across Canada and change over time. We cannot advise on provincial inspection outcomes, and a unit that fails an inspection or a registration requirement is not a defect and is not grounds for return under warranty.

10. Export orders

On any shipment leaving Canada, you are the importer of record and are responsible for all duties, taxes, brokerage and customs charges, and for compliance with the import rules of the destination country. Warranty coverage on units exported outside Canada is limited to a refund of the purchase price, with freight at your cost.

11. Use of this website

The content of this site – text, photographs, listings and layout – belongs to us or our suppliers and may not be copied, scraped or republished without written permission. You may not use this site to place fraudulent orders, to harvest data, or in any way that interferes with its operation. We may withdraw or change any part of the site without notice, and we do not warrant that it will be uninterrupted or error-free.

Manufacturer names, engine codes and model designations are used for identification only. We are not an authorised dealer for, or affiliated with, any vehicle manufacturer.

12. Privacy

How we collect, use and store your personal information is set out in our Privacy Policy.

13. Disputes and governing law

These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada, and the courts of British Columbia have jurisdiction. Before starting any formal proceeding, please contact us – the overwhelming majority of problems are resolved with one phone call to 672 763 0632.

14. Changes to these terms

We may update these terms from time to time. The version published on this page at the moment you place an order is the version that applies to that order. If a provision of these terms is found unenforceable, the remainder continues to apply.

Call us and ask – we would rather explain a term than argue about it later.
